SiteComply is a software tool that compiles WHS document skeletons from a pre-validated library of structured content atoms (hazards, controls, PPE, legislation references) and applies a small AI-driven narrative layer for site-specific contextualisation. The compiled document must be authored by a named competent person before any export or use.
Every document compiled by the platform must be signed off by a named competent person. That competent person is the legal author of the document and bears statutory responsibility for its content under WHS law. The platform records the signer's name, role, optional licence number, IP address, and timestamp at sign-off as immutable evidence of authorship.
To the maximum extent permitted by law, SiteComply's liability is limited to the amount paid by the user in the 12 months prior to the event giving rise to the claim, or AUD$100 (whichever is greater). The platform is provided "as is" without warranty of any kind. SiteComply is not liable for any indirect, incidental, special, consequential, or punitive damages.
Nothing in these terms excludes or limits any non-excludable consumer guarantees under the Australian Consumer Law.
The user indemnifies SiteComply against any claims, damages, or losses arising from: (a) the user's use of the platform; (b) the user's breach of these terms; (c) any document compiled by the user and authored by a competent person under their direction; (d) the user's violation of any law or third-party rights.
SiteComply supports both individual user accounts and organisation accounts (teams). The following provisions apply to organisation accounts:
Enterprise users (organisations with multiple projects, sites, or managed subcontractor networks) accept the following additional obligations:
The platform stores documents, atom snapshots, audit logs, and user account data in support of the service. Data is retained for the document retention period set per document (default 7 years for compliance documents, in line with AU records retention norms). All data is stored in Australia (AWS ap-southeast-2 / Sydney). The platform does not share user data with third parties except as required to provide the service or as required by law. For organisation accounts, the organisation is the data controller for personal information of its members and associated workers/subcontractors entered into the platform. SiteComply acts as a data processor on the organisation's behalf for that personal information.
Either party may terminate use of the platform at any time. On termination, the platform retains documents and audit logs for the applicable retention period. Users and organisation admins may request a full data export at any time during or after the retention period by contacting contact@sitecomply.au.
These terms are governed by the laws of New South Wales, Australia. Any disputes are subject to the exclusive jurisdiction of the courts of New South Wales.
