Terms of Use

Beta — research project. These terms are an initial draft pending legal review. Use of the platform during the beta period is at the user's sole risk and is provided free of charge. By using the platform you accept these terms.

1. The service

SiteComply is a software tool that compiles WHS document skeletons from a pre-validated library of structured content atoms (hazards, controls, PPE, legislation references) and applies a small AI-driven narrative layer for site-specific contextualisation. The compiled document must be authored by a named competent person before any export or use.

2. User obligations

  • You will only use the platform in connection with work for which you (or a person under your direction) are a competent person under WHS law.
  • You will not represent the platform as the author of any document. The named competent person is the author.
  • You will verify each compiled document against current legislation in your jurisdiction before use.
  • You will select the correct jurisdiction (state/territory) for each document.
  • You will not attempt to bypass the competent-person sign-off enforcement.
  • You will not use the platform for unlawful purposes.

3. Document authorship and liability

Every document compiled by the platform must be signed off by a named competent person. That competent person is the legal author of the document and bears statutory responsibility for its content under WHS law. The platform records the signer's name, role, optional licence number, IP address, and timestamp at sign-off as immutable evidence of authorship.

4. Limitation of liability

To the maximum extent permitted by law, SiteComply's liability is limited to the amount paid by the user in the 12 months prior to the event giving rise to the claim, or AUD$100 (whichever is greater). The platform is provided "as is" without warranty of any kind. SiteComply is not liable for any indirect, incidental, special, consequential, or punitive damages.

Nothing in these terms excludes or limits any non-excludable consumer guarantees under the Australian Consumer Law.

5. Indemnification

The user indemnifies SiteComply against any claims, damages, or losses arising from: (a) the user's use of the platform; (b) the user's breach of these terms; (c) any document compiled by the user and authored by a competent person under their direction; (d) the user's violation of any law or third-party rights.

6. Team and organisation accounts

SiteComply supports both individual user accounts and organisation accounts (teams). The following provisions apply to organisation accounts:

  • The organisation's account administrator (“Admin”) is responsible for managing user access, roles, and permissions within the organisation account.
  • The Admin accepts these terms on behalf of the organisation and all users within it. It is the Admin's responsibility to ensure all users are aware of and comply with these terms.
  • All documents compiled and signed under an organisation account are owned by the organisation, not the individual user who created them. On termination of a user's access, documents remain accessible to the organisation.
  • The organisation is liable for the actions of all users operating under its account, including any documents generated or signed by those users.
  • Users invited into an organisation account acknowledge that their document activity is visible to the organisation's administrators.
  • Subcontractor connections made through the platform (where a principal contractor links to a subcontractor's organisation) are subject to the acceptance of both parties and may be terminated by either party at any time.

7. Enterprise and multi-site use

Enterprise users (organisations with multiple projects, sites, or managed subcontractor networks) accept the following additional obligations:

  • Where a document compiled on the platform is to be used across multiple sites or by multiple workers, the named competent person who signed off the document remains the legal author for all instances of use.
  • The enterprise account holder is responsible for ensuring that the competent person's sign-off is appropriate in scope for all intended uses of the document.
  • The platform does not warrant that a document signed for one site or work scope is compliant for use at a different site or work scope. A new document or amendment should be compiled and signed for materially different work or sites.
  • Enterprise accounts may connect with subcontractor organisations via the platform portal. The principal contractor is responsible for verifying the credentials, licensing, and insurance of connected subcontractors independently of the platform's “Verified” status indicator. The Verified badge confirms only that a signed SWMS exists in the platform — it is not a representation of the subcontractor's suitability, licensing, or insurance status.

8. Data processing and privacy

The platform stores documents, atom snapshots, audit logs, and user account data in support of the service. Data is retained for the document retention period set per document (default 7 years for compliance documents, in line with AU records retention norms). All data is stored in Australia (AWS ap-southeast-2 / Sydney). The platform does not share user data with third parties except as required to provide the service or as required by law. For organisation accounts, the organisation is the data controller for personal information of its members and associated workers/subcontractors entered into the platform. SiteComply acts as a data processor on the organisation's behalf for that personal information.

9. Termination

Either party may terminate use of the platform at any time. On termination, the platform retains documents and audit logs for the applicable retention period. Users and organisation admins may request a full data export at any time during or after the retention period by contacting contact@sitecomply.au.

10. Governing law

These terms are governed by the laws of New South Wales, Australia. Any disputes are subject to the exclusive jurisdiction of the courts of New South Wales.
